Welcome to spyglassrealty.com (the "Site"), operated by Spyglass Realty ("Spyglass," "we," "us," or "our"), a licensed real estate brokerage located in Austin, Texas. These Terms of Service ("Terms") govern your access to and use of the Site, including any content, functionality, and services offered on or through it.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility and Acceptance

By using this Site, you represent that you are at least 18 years old and capable of entering into a legally binding agreement. If you are using the Site on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

2. Use of the Site

You may use the Site for lawful, personal, non-commercial purposes related to searching for, buying, selling, or leasing real property, or learning about our services. You agree not to:

  • Use the Site for any unlawful purpose or in violation of any local, state, or federal law;

  • Scrape, "crawl," data-mine, or use automated systems to extract listing data, images, or content without our prior written consent or in violation of our MLS's IDX rules;

  • Copy, reproduce, republish, distribute, or create derivative works from Site content without authorization;

  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems or networks;

  • Interfere with or disrupt the Site's functionality, including through malware, denial-of-service attacks, or similar means;

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;

  • Use the Site to transmit spam, unsolicited communications, or fraudulent content.

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful to us, other users, or third parties.

3. Real Estate Listing Data (IDX/MLS Content)

Property listing information displayed on the Site may be provided in whole or in part through Internet Data Exchange ("IDX") feeds from one or more Multiple Listing Services ("MLS"). By using this Site, you acknowledge and agree that:

  • Listing data, including but not limited to prices, square footage, property details, and photographs, is deemed reliable but is not guaranteed and should be independently verified;

  • Listing information may be provided by third parties (including other brokerages and their agents) and Spyglass does not independently verify its accuracy or completeness;

  • Listing data may change without notice, and properties may be sold, withdrawn, or otherwise unavailable at any time;

  • Listing information is protected by copyright and other intellectual property rights held by the applicable MLS and/or listing brokers, and may not be copied, redistributed, or used for any purpose other than your personal, non-commercial use in evaluating properties, except as permitted by the applicable MLS's IDX policy;

  • Some listings on the Site may be listed by brokerages other than Spyglass Realty, and are marked accordingly where required by MLS rules.

4. Fair Housing Statement

Spyglass Realty is committed to compliance with the Federal Fair Housing Act and all applicable state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, or any other characteristic protected by law. All property listings on this Site are offered without regard to any protected characteristic.

5. No Real Estate, Legal, or Financial Advice

Content on the Site — including blog posts, market data, calculators, neighborhood guides, and similar materials — is provided for general informational purposes only and does not constitute real estate, legal, financial, or tax advice. You should consult a licensed real estate agent, attorney, financial advisor, or tax professional regarding your specific situation before making decisions related to buying, selling, or financing property.

6. Accounts and Registration

Certain features of the Site (such as saved searches or property alerts) may require you to create an account or provide contact information. You agree to provide accurate and current information and to keep it updated. You are responsible for maintaining the confidentiality of any login credentials and for all activity under your account.

7. Communications and Consent

By submitting your contact information through the Site (including forms, chat features, or saved search sign-ups), you consent to be contacted by Spyglass Realty and its affiliated agents via phone, email, or text message, including through automated systems, regarding real estate services. Message and data rates may apply. You may opt out of marketing communications at any time by following the unsubscribe instructions provided or by contacting us directly.

8. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, videos, and software — is the property of Spyglass Realty or its licensors and is protected by copyright, trademark, and other intellectual property laws, except for listing data owned by third-party MLS participants as described in Section 3. You may not use, reproduce, or distribute any Site content without our prior written permission, except for personal, non-commercial use as expressly permitted by these Terms.

9. Third-Party Links and Services

The Site may contain links to third-party websites, tools, or services (such as mortgage calculators, mapping services, or social media platforms) that are not owned or controlled by Spyglass Realty. We are not responsible for the content, accuracy, or practices of any third-party sites, and linking to them does not imply endorsement.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. SPYGLASS REALTY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT LISTING DATA OR OTHER CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPYGLASS REALTY AND ITS OWNERS, AGENTS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED [INSERT AMOUNT, e.g., ONE HUNDRED DOLLARS ($100)].

14. Changes to These Terms

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spyglass Realty regarding your use of the Site and supersede any prior agreements.
